Hash House Hub Terms of Use

By installing the HashHouse App (as defined below), you acknowledge your consentto be unconditionally bound by the following terms of use, including any futurechanges ("Terms"), without limitation or qualification. Please read these Termscarefully before using this HashHouse App (as defined below). These Terms may berevised at any time by updating this posting. You are bound by any such revisionsand should therefore periodically visit this page to review the current Terms to whichyou are bound. Each time a user accesses the HashHouse App, the user shall bedeemed to have consented, by such access and/or use, to the Terms, as amendedand/or replaced by Company (as defined below) from time to time. If you are notsatisfied with the amended Terms, you should refrain from using and/or downloadingthe HashHouse App. If you are under the age of 18, you must obtain your parents' orlegal guardians' advance authorization, permission, and consent to be bound by theseTerms before downloading and/or using the HashHouse App.

1. DEFINITION

The “HashHouse App” shall mean the software provided by Poseidon Tech HKLimited (“Company”) for the purpose of providing information including, but notlimited to, real-time or historical hashrate, device monitoring, operational statusdisplay, analytics visualization, and estimated mining details in connection with theuse of the Company’s mining technology, and to be used on Apple iOS and AndroidOS devices, together with any upgrades, updates, and related software ordocumentation that enable the use of the HashHouse App.

2. PROPRIETARY RIGHTS AND LICENCE

2.1 All intellectual property rights (including trademarks, service marks, trade names, company names, logos, icons, slogans, copyrights, domain names, patents, designrights, utility models, database rights, know-how, trade secrets and all otherintellectual or industrial property rights including, where such rights are obtained orenhanced by registration, any registration of such rights (including the right to applyfor such registrations) and HashHouse App therefore (including the right to claimpriority) relating to this HashHouse App or the contents of this HashHouse App arethe property of, or licensed to, the Company and/or its associated companies. Otherthan as expressly set out in these terms and except as permitted by applicable law, nothing contained in the HashHouse App should be construed as granting, byimplication, estoppel, or otherwise, any license or right to use any of such intellectualinquiry@hashhouse.tech | www.hashhouse.techproperty rights without the written express permission of the Company or the relevantlicensors or owners of such intellectual property rights. Your use of such intellectualproperty rights, or any other content on this website, except as provided herein, isstrictly prohibited.

2.2 The Company hereby grants you a worldwide, non-exclusive, royalty-freerevocable licence to use the HashHouse App only for your personal non-commercialuse in accordance with these terms. No other rights to the HashHouse App aregranted. All rights, including intellectual property rights in the software, remain theproperty of the Company or the relevant licensors or owners of the software, andexcept as permitted by law, you may not reverse engineer, decompile, modify, ortamper with the software.

3. CONDITIONS OF USE

3.1 You will not, nor allow third parties on your behalf to (i) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, or translate the HashHouse App; or (ii) create derivative works of the HashHouse Appof any kind whatsoever.

3.2 No warranty, representation, or guarantee of any kind whatsoever relating to theinformation and material contained in or displayed on the HashHouse App is given ormay be implied. The Company shall not in any circumstances whatsoever be liable orresponsible for any inaccuracies, incompleteness, omissions, mistakes or errors insuch information or material, or for any economic or any other loss or damage, whether occasioned by negligence or otherwise whatsoever, incurred, sustained orsuffered by the recipient or viewers of the information or material or any other person, whether directly or indirectly, arising out of or in connection with such information ormaterial, its compilation, distribution, dissemination or use thereof or reliance thereonor otherwise howsoever. The HashHouse App is currently made available to you freeof charge for your personal, non-commercial use. The Company reserves the right toamend or withdraw the HashHouse App, or charge for the HashHouse App or serviceprovided to you in accordance with these terms, at any time and for any reason.

3.3 The HashHouse App is free, but there may be charges incurred from your telecomservice providers for data connection, data download, data rate plans, or roaming. You are responsible for any mobile data subscription, data transfer, and other datacosts, roaming charges, or other fees that may be charged by your network serviceprovider.

3.4 If you are not the bill payer for the mobile telephone or handheld device beingused to access the HashHouse App, you will be assumed to have received permissionfrom the bill payer for using the HashHouse App.

3.5 The Company does not provide financial services, exchange services, custodyservices, brokerage services, or investment advice via the HashHouse App, nor is itresponsible for any services through which you access the HashHouse App or for anyloss you may suffer as a result of using such connected services. You must complywith all the terms and conditions of such service and pay all the charges connectedwith it. We recommend you contact your network service provider for informationabout data transmission and other network service charges.

3.6 The Company does not hold, control, or manage users’ crypto assets or privatekeys. You are entirely responsible for maintaining the confidentiality of your ownpasswords and account details. You are also entirely responsible for any activityrecords that occur under your account, regardless of whether such records were madewith or without your knowledge or authority. The Company shall not be liable for anydamage, loss, or other liability incurred by you arising from any records of any kindwhatsoever resulting from the unauthorized use of accounts and passwords by anythird parties. However, you may be held liable for any damage, loss, or other liabilityincurred by the Company for any wrongful use of your account and/or password. Youshall report to the Company immediately if you know or have reason to suspect thatthe security of your password and/or account may have been compromised or usedby another person without authority.

3.7 Your use of your account and/or password to access or use this HashHouse Appwill be recognized as your electronic signature and will be legally binding. You acceptthat electronic records will be admissible as original documents in any court of lawand agree that you will not challenge or dispute the accuracy or authenticity of suchrecords.

3.8 You acknowledge that when you download, install, or use the HashHouse App, Company may use automatic means (including, for example, cookies and webbeacons) to collect information about your mobile device that has installed theHashHouse App and about your use of the HashHouse App. You also may be requiredto provide certain information about yourself as a condition to downloading, installing, or using the HashHouse App or certain of its features or functionality, and theHashHouse App may provide you with opportunities to share information aboutyourself with others. All information we collect through or in connection with this HashHouse App is subject to our Privacy Policy located at www.[*]/privacy. Bydownloading, installing, using, and providing information to or through theHashHouse App, you consent to all actions taken by us with respect to yourinformation in compliance with the Privacy Policy.

3.9 You acknowledge and understand that the information shown on the HashHouseApp, including but not limited to real-time hashrate, estimated mining rewards, hashrate earned amount, and mining performance, settlement time, daily averagehashrate, status, and other operational data, is for informational and monitoringpurposes only. Such information depends on external factors including but not limitedto network difficulty, mining pool performance, block rewards, market conditions, energy availability, hardware status, and other variables outside the Company’scontrol, and may be subject to delays, inaccuracies, calculation differences, ordiscrepancies due to network conditions, third-party mining pool data, system latency, or other external factors. In the event of any inconsistency between informationdisplayed on the HashHouse App and the official records maintained by the miningpool backend, system server, or other designated authoritative data source operatedor specified by the Company, the data recorded by such backend systems orauthoritative sources shall prevail for all purposes, including but not limited toperformance evaluation and benefit calculations.

3.10 We may regularly make updates on the HashHouse App, and failure by you tosynchronize the latest HashHouse App with your handheld mobile device may lead toyour HashHouse App not working or displaying incorrect information. The Companywill not be liable for the loss or inconsistency of information arising due to failure tosynchronize the HashHouse App in a regular manner.

3.11 We are not responsible for information incorrectly submitted to the HashHouseApp and shall not be responsible for any consequences, financial or otherwise, arisingfrom inaccurate, incorrect, or wrong information submitted on the HashHouse App, nor shall we be responsible for the profitability, mining efficiency, or financialoutcomes resulting from the operation of any hardware connected to the HashHouseApp.

4. INDEMNITY

4.1 You hereby agree to fully indemnify, defend and hold harmless the Company fromand against any and all damages, losses, liabilities, costs and expenses (including fulllegal costs on a solicitor-client basis) suffered by the Company arising from or inconnection with: (i) your access to or use of this HashHouse App, including yoursubmission of any material through this HashHouse App; (ii) any other party's access to or use of this HashHouse App using your account and/or password; or (iii) yourbreach of any of these terms; (iv) any other party's breach of any of these terms

where such party was able to access or use this HashHouse App using your accountand/or password.

4.2 You expressly agree to release us (the “Released Parties”) from any and allliability connected with your activities as recorded through the HashHouse App, andpromise not to sue the Released Parties for any claims, actions, injuries, damages, orlosses associated with your activities. You also agree that in no event shall theReleased Parties be liable to you or any third party for any direct, indirect, punitive,incidental, special or consequential damages, including but not limited to loss ofprofits, loss of revenue, loss of mining rewards, or loss arising from estimated orprojected performance, arising out of or in any way connected with (a) your use ormisuse of the services, (b) your use or misuse of equipment or programs created byus while engaged in your activities, (c) your dealings with third party serviceproviders, including mining pools, external service providers or advertisers availablethrough the HashHouse App, (d) any delay or inability to use the HashHouse Appexperienced by you, (e) any information, software, products, services or contentobtained through the HashHouse App, whether based on contract, tort, strict liabilityor otherwise, even if we have been advised of the possibility of such damages. TheCompany is not responsible for third-party services or data accuracy. To themaximum extent permitted by applicable law, the total aggregate liability of theCompany arising out of or in connection with the HashHouse App shall not exceedthe greater of (i) USD $50 or (ii) the amount paid by you, if any, to use theHashHouse App during the twelve (12) months preceding the claim. For avoidance ofdoubt, if the HashHouse App is provided free of charge, the Company’s total liabilityshall be limited to USD $50.

4.3 Nothing in these Terms shall exclude or limit any liability that cannot be excludedor limited under applicable laws of Hong Kong

5. DISCLAIMERS AND RISK ACKNOWLEDGEMENT

5.2 The HashHouse App provides monitoring and informational tools only. TheCompany does not provide financial services, exchange services, custody services, brokerage services, or investment advice. Any estimated mining data, estimatedearnings, or projected performance displayed in the HashHouse App is provided forreference and informational purposes only

5.3 The Company does not hold, control, or manage users’ crypto assets, digitalwallets, or private keys. Users remain solely responsible for their mining configuration, accounts, and any digital assets associated with their activities.

5.4 Hashrate, estimated mining rewards, and mining performance depend on externalfactors, including but not limited to network difficulty, mining pool performance, block rewards, market conditions, energy availability, hardware status, and othervariables outside the Company’s control. The Company does not guarantee miningrewards, income, profitability, or financial returns.

5.5 Users acknowledge that certain information displayed within the HashHouse Appmay be derived from third-party mining pools or external data sources and may besubject to delays, inaccuracies, or discrepancies. Users are responsible for complyingwith all applicable local laws, regulations, and sanctions requirements when usingthe HashHouse App and any related hardware or services.

6. AVAILABILITY

6.1 This HashHouse App is available to handheld mobile devices running Apple iOSand Android OS Operating Systems. The Company will use reasonable efforts tomake the HashHouse App available at all times. However, you acknowledge that theHashHouse App is provided over the internet and mobile networks, and so the qualityand availability of the HashHouse App may be affected by factors outside theCompany's reasonable control.6.1

6.2 We do not warrant or make any representations as to the security of thisHashHouse App, nor do we warrant that functions or materials accessible from orcontained in this HashHouse App will work uninterrupted or error-free, that defectswill be corrected, or that this HashHouse App is free from viruses or other harmfulelements.

7. SYSTEM REQUIREMENTS

7.1 In order to use the HashHouse App, you are required to have a compatible mobiletelephone or handheld device, internet access, and the necessary minimumspecifications (“Software Requirements”).

7.2 The HashHouse App may only be used on compatible iOS and Android devicesand may require certain software, operating system, or technical specifications inorder to function properly. Such requirements may be updated from time to time.

7.3 The version of the HashHouse App software may be upgraded from time to timeto add support for new functions and services.

8. TERMINATION

8.1 The Company may change the format and content of this HashHouse App at anytime. We may suspend the operation of this HashHouse App for support ormaintenance work in order to update the contract or for any other reason. We havethe right to terminate access to this HashHouse App at any time and without notice.

8.2 Upon any termination, (a) the rights and licenses granted to you herein shallterminate; (b) you must cease all use of the HashHouse App.

9. GENERAL

9.1 The invalidity, unlawfulness, or unenforceability of any provision in these terms inany respect under applicable law shall not affect the validity, legality, orenforceability of the remaining provisions hereof.9.1

9.2 The HashHouse App is intended for use only in jurisdictions where such use ispermitted by applicable law. It is your responsibility to ensure that your access toand use of the HashHouse App complies with all applicable laws, regulations, sanctions, and restrictions in your jurisdiction. The Company makes no representationthat the HashHouse App is appropriate, available, or lawful for use in everyjurisdiction, and may restrict or refuse access to the HashHouse App in certainjurisdictions at its sole discretion.

9.3 These terms are governed by the laws of Hong Kong and the parties agree tosubmit to the exclusive jurisdiction of the courts of Hong Kong.

9.4 No failure to exercise, and no delay in exercising, on the part of either party, anyright or any power hereunder shall operate as a waiver thereof, nor shall any singleor partial exercise of any right or power hereunder preclude further exercise of that orany other right hereunder. In the event of a conflict between the Terms and otherterms, the Terms shall govern.
